  1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Advertiser", "you", "your") and SIE Invest Group Pty Ltd (ABN 72 682 515 895)("mwamwa.com", "we", "us", "our") governing your access to and use of the mwamwa.com website (the "Site") and related advertising services (the "Services").

By registering for an account and using our Services, you:  acknowledge that you have read, understood, and agree to be bound by these Terms;  warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement;  acknowledge that these Terms incorporate by reference our Privacy Policy and Refund Policy.

If you do not agree to these Terms, you must not access or use the Site or Services.

  1. Nature of Services

mwamwa.com operates an online advertising platform that allows advertisers to publish listings for social escort services within Australia. We are an “interactive computer service” providing a venue for advertisements. We are not a party to any agreements or transactions between Advertisers and users of the Site. We do not endorse, guarantee, or assume any responsibility for the accuracy of any listing or the conduct of any user.

  1. Account Registration and Security

3.1. You must provide accurate and complete information during registration and keep it updated. 3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must promptly notify us at [admin@mwamwa.com] of any unauthorized use of your account. 3.3. We employ standard security measures, including 256-bit SSL encryption and PCI-Compliant payment gateways. However, you acknowledge that no data transmission over the internet is 100% secure and you use the Services at your own risk. We are not liable for any losses arising from unauthorized access to your account due to your failure to protect your credentials. 3.4. We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms. 4. Advertising Services

4.1.Fees and Periods. Advertising fees and periods (e.g., Standard, Featured, Boosts) are as listed on the Site. All fees are quoted in Australian dollars and are exclusive of GST. We reserve the right to change our fees and plans upon 14 days' notice published on the Site. 4.2.Payment. All payments must be made in advance through our designated third-party payment gateways. You agree to comply with the terms of the payment gateway provider. We are not liable for any issues arising from the use of these third-party services. 4.3.Renewals. We will provide reasonable notice prior to the expiration of your advertising period. It is your responsibility to renew your listing. Failure to renew may result in its removal. 4.4.Boosts. "Boosts" are promotional features that may enhance the visibility of your listing for a limited time but do not extend the base advertising period.

  1. Advertiser Content and Conduct

5.1. Your Warranties. You represent and warrant that any content you submit ("Advertiser Content"):  is owned by you or you have all necessary rights to use and license it;  is accurate, truthful, and not misleading;  complies with all applicable Australian laws and regulations, including but not limited to laws concerning prohibited content, privacy, and anti-discrimination;  does not infringe any third party's intellectual property, privacy, or other rights;  is not defamatory, obscene, threatening, or hateful.

5.2. License Grant. You retain ownership of your Advertiser Content. You grant us a worldwide, royalty-free, sub-licensable, and transferable license to use, host, store, reproduce, modify, publish, and display your Advertiser Content solely for the purpose of operating, promoting, and improving the Services. This license terminates within a commercially reasonable time after you remove the content or terminate your account.

5.3. Prohibited Content/Conduct. You must not:  Post content that violates Clause 5.1.  Impersonate any person or entity.  Engage in fraudulent or deceptive practices.  Use the Services if you are under 18 years of age.

5.4. Moderation. We reserve the right, but not the obligation, to screen, moderate, edit, remove, or refuse any Advertiser Content at our sole discretion and without notice if we believe it violates these Terms or is otherwise harmful to our business. Moderation time-frames are estimates only and we are not liable for delays.

  1. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WILL BE SECURE FROM LOSS OR UNAUTHORIZED ACCESS.

  1. Limitation of Liability

7.1. To the fullest extent permitted by law, in no event shall mwamwa.com, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:  your access to or use of or inability to access or use the Services;  any conduct or content of any third party on the Services;  any unauthorized access to or use of our servers and/or any personal information stored therein;  any interruption or cessation of transmission to or from the Services.

7.2. Our total aggregate liability for any claims under these Terms shall be limited to the total fees paid by you to us in the six (6) months preceding the event giving rise to the claim.

7.3. Nothing in these Terms seeks to exclude or limit liability for matters which cannot be excluded or limited under applicable law, including the Australian Consumer Law. Where the ACL applies, our liability for any breach of a consumer guarantee is limited to, at our option: the supplying of the services again; or the payment of the cost of having the services supplied again.

  1. Indemnification

You agree to indemnify, defend, and hold harmless mwamwa.com and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:  your use of and access to the Services;  your violation of any term of these Terms;  your violation of any third-party right, including without limitation any copyright, property, or privacy right;  any claim that your Advertiser Content caused damage to a third party.

  1. Termination

We may suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately. Sections 5, 6, 7, 8, and 10 shall survive termination.

  1. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wale and the Commonwealth of Australia.

  1. General

11.1. Changes to Terms: We may modify these Terms at any time. We will provide notice of material changes by posting the new Terms on the Site. Your continued use of the Services after such changes constitutes your acceptance of the new Terms. 11.2. Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Services. 11.3. Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. 11.4. No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
